JQM panel height not set to viewpot

iScrollview for jqm panel is not fill up the available height of the viewport. The scroll bar on the side of the panel only goes down to about 80% of the view port and the stops, almost where the foot is located.

My footer has a nav bar element in it, is this the source of my issue?

I have the resizeWrapper set to false in the js, but set to true for my panel in its options
