This change fixes the bug that @naricc hit in his PR #81012 when trying to limit the test set for the purpose of speeding up lab response in certain experiments. My original implementation of Helix publishing changes related to merged tests was incorrect with respect to the case when there are no merged tests in the test set, a situation I never hit as I was making these changes parallel to the first wave of test merging. I have verified by means of the instrumented run
