Software Terms of Use

The Connect for Life™ software (powered by Global Public Health, a division of Janssen Pharmaceutica NV) is provided to Implementor under the terms of the Mozilla Public License Version 2.0 (“MPL 2.0”). By using and/or contributing to the Connect for Life™ software, Implementor acknowledges that it has read the terms of the MPL 2.0 and agrees to comply with the terms thereof.

The Connect for Life™ software is not intended to be used in relation with the provision of any medical service or to diagnose or treat any health-related disease or condition.

Any use, reproduction, making available, modification, display, performance, distribution or exploitation of the Connect for Life™ software by Implementor shall be in strict compliance with all applicable local, state, federal, national and international laws. In particular, Implementor agrees to protect the confidentiality of any data collected, processed, used and/or shared by means of the Connect for Life™ software and which constitutes personal data, including but not limited to patient health and medical information in compliance with all applicable local, state, federal, national and international privacy laws and regulations (e.g. HIPAA, the European Union Data Protection Directive). Janssen Pharmaceutica NV (“JANSSEN”) shall have no responsibility, statutory or otherwise, in respect thereof.

Further, under no circumstance shall Implementor use, reproduce, make available, display, perform, distribute or exploit the Connect for Life™ software in a manner or for a purpose that is intentionally dishonest, misleading, fraudulent or negligent, or which may cause harm, injury or damage to a third party.

The Connect for Life™ software is provided on an “as is” basis, without warranty of any kind, either expressed, implied or statutory including, without limitation, that the Connect for Life™ software is free of defects, merchantable, fit for a particular purpose or non-infringing. The entire risk as to the quality and performance of the Connect for Life™ software is with Implementor. JANSSEN shall not be held responsible for any communication, information or advice given by means of the Connect for Life™ software. Implementor will hold JANSSEN, its directors, appointed representatives or employees harmless against all claims of any kind whatsoever that may arise or result from the use, reproduction, making available, modification, display, performance, distribution or exploitation of the Connect for Life™ software by Implementor.
